While no claim exists under federal law for the time spent undergoing screenings, this is not always the case under state labor law. Because employees were required to “clock out” before undergoing the security screening, they were not compensated for their time spent waiting in line for and then undergoing the screenings. The policy worked like this: “At the end of their respective shifts, hundreds, if not thousands, of warehouse employees would walk to the timekeeping system to clock out and were then required to wait in line in order to be searched for possible warehouse items taken without permission and/or other contraband.” The workers claimed that “Defendants’ policy of requiring hourly warehouse employees to undergo a thorough security clearance before being released from work and permitted to leave the employer’s property was solely for the benefit of the employers and their customers.” The employees also claimed that this screening process took approximately 25 minutes each day, and that they were also required to undergo the same security clearance prior to taking their lunch breaks, thereby reducing the full thirty-minute break they were supposed to receive. Under the policy, Plaintiffs and all other hourly paid, non-exempt employees were required to “undergo a daily security clearance check at the end of each shift to discover and/or deter employee theft of the employer’s property and to reduce inventory ‘shrinkage.’” This case involved a security clearance policy that was enforced at all Amazon locations throughout the United States. If Teague does go to the NBA, twice committed to North Carolina State Torian Graham is a possibility for another SG and he has the size (6’4) that Calipari likes. I think that Kentucky could fill their class with one or two of these players if needed. If Kentucky strikes out on those and still needs a big, you get the feeling that Amile Jefferson is ready to step right in as well. #33 Tony Parker is the best remaining center after Noel and there has been pretty positive buzz surrounding him and Kentucky as well. Pollard is scheduled to visit Missouri soon, but you would have to think that Kentucky jumps to near the top of his list again if Calipari got more involved. We have not heard much about SF Devonta Pollard, but he is still a top #10 prospect. Kentucky has another top rated class, but still has one more scholarship to fill. For the sake of argument, let’s say Kentucky lands Noel and Muhammad, but loses Bennett to someone else. I say that Kentucky get at least one of these three, but more than likely two, and I have not closed the book on all three. Noel can avoid the indecision of the Syracuse roster situation and have a scholarship waiting for him in Lexington today. There are reports that Syracuse may not even have a scholarship unless Fab Melo leaves. Kentucky is also very heavily involved with Noel and the fact is, Kentucky is probably the only school with the scholarships to land all three. Until there is a LOI in, these are just rumors. There are also rumors that Muhammad will go to UCLA or that both Muhammad and Bennett may stay home at UNLV. Kentucky is obviously very involved in both Bennett and Muhammad as Calipari was in Las Vegas last week to visit them. What are the odds of this happening? I say about 60% as of right now. With this haul, Kentucky would have to be considered the favorite for the 2013 national Title as well.
